The paper analyzes the Insurance Arbitrator (AAS), introduced by Interministerial Decree No. 215 of November 6, 2024, as a new alternative dispute resolution mechanism in the insurance sector. After examining the relationship between the AAS and mediation and assisted negotiation as alternative conditions of procedibility, the Author highlights its main critical aspects: the uncertain boundaries with the ABF, excessively low value thresholds, and non-binding nature of its decisions. The analysis continues from a comparative perspective, comparing the Italian model with the British Financial Ombudsman Service, the German Versicherungsombudsmann, and the US system. The findings suggest that while the AAS represents an important step towards strengthening consumer protection, it presents structural weaknesses that may undermine its effectiveness, indicating the need for future corrective measures inspired by more mature experiences.
